New Customer Rental Application & Agreement

The undersigned represents and warrants that the information contained herein is true and accurate to the best of its knowledge. The undersigned has read and understood the above terms and conditions and agrees to prompt payment of each and every invoice rendered to the customer by Forming America, LLC. All rental equipment and associated hardware remains the property of Forming America, LLC. for the duration of the rental. Any movement of the equipment from the original designed jobsite shall be reported to Forming America, LLC. prior to movement. By leasing our equipment, the lessee assumes any and all responsibility for losses and damages. Any period of time over the agreed rental period, as well as any shortages of equipment, will be billed at a standard rate and is the financial responsibility of the lessee. Forming America, LLC requires the full and complete project name and street address for every rental. The General Contractor for each project shall also be provided upon the request of Forming America, LLC.

The undersigned, hereby personally guarantees payment of the account and of each and every invoice rendered to the customer by Forming America, LLC and all expenses of collection, including attorney fees. This guarantee is and shall be in full force effect until it is cancelled in writing, forwarded to Forming America, LLC by Registered Mail, Return Receipt Requested. The said cancellation will be effective commencing twenty-four (24) hours after receipt thereof by Forming America, LLC. *NO CORPORATE TITLE BELOW. This guarantee must be signed personally by an owner/principal listed above.

PAYMENT All orders are Cash On Delivery.. The first rental premium are expected at the time of delivery/pickup by company check or credit card. NO EXCEPTIONS! Any rental equipment not returned before the first 28 days will incur prorated daily rental charges and will be billed every 28 days or when the equipment is returned to our yard. The additional rental invoices must be paid promptly. RELOCATION It is strictly forbidden to transfer forms from the original job site to another job site. If relocation is desired, Forming America must be notified in writing. If the relocation is approved by Forming America, a relocation agreement must be signed by the customer and received by Forming America BEFORE moving the forming equipment. INCORRECT COUNTS Customers must notify Forming America, LLC within 24 hours of the time of delivery/pickup if they believe a delivery or return count is incorrect. It is not acceptable to claim that the original delivery count was incorrect at the time of return. DELIVERY/PICKUP Forming America LLC requires four (4) days notice to schedule a delivery or pick-up of any rental equipment. Charges for this service are based on one delivery and one pickup. For additional deliveries/pick-ups, charges will be assessed depending on the location. Customers can also pick up/drop off equipment at our office between the hours of 7am to 3pm, Monday through Friday. Rental equipment left outside of our gate will remain the responsibility of the lessee. LOADING/UNLOADING It is the responsibility of the Lessee to have equipment and personnel to unload and load the rental equipment. Additional charges of $50 per hour may be charged for the detention of our driver and for the loading and unloading by the driver. ADDITIONAL CHARGES Additional charges for the loss of equipment, damages, excessive cleaning, or missed scheduled deliveries and pickups will be billed accordingly. All rentals past the first 28 days continue to incur daily rental charges and will be billed at a prorated rate.
